The legal framework

The Court ruling on a dismissal for serious misconduct following abusive sick leave affirms that there is only a violation of the employee's duty of loyalty, vis-à-vis the employer, if the parallel activity carried out by the employee is detrimental to him. However, the activity incriminated by the employee being concurrent with that of the business manager, in this case the damage does not need to be demonstrated and the detective's report is admissible before the Court.

Medical control is a right that can be exercised by the employer who pays a salary supplement according to the monthly payment law of January 19, 1978.
